CaseFlo provides a professional communication and documentation platform designed for healthcare and professional service providers. The platform includes:

• Secure data management infrastructure
• Professional communication tools

2.2 Service Limitations

CaseFlo makes no guarantees regarding:

• Continuous, uninterrupted service availability
• Complete data protection
• Absolute accuracy of transcription or recording services

3. User Obligations

3.1 Account Management

Users are exclusively responsible for:

• Maintaining account security and confidentiality
• All activities occurring under their account
• Ensuring accuracy of provided information
• Immediate notification of any unauthorized access

3.2 Prohibited Activities

Users are explicitly prohibited from:

• Attempting to compromise platform security
• Transmitting inappropriate or illegal content
• Interfering with other users' communications
• Reverse engineering or attempting to replicate platform functionality

4. Intellectual Property Rights

4.1 Ownership

All intellectual property rights in the CaseFlo platform, including but not limited to software, design, algorithms, and documentation, remain the exclusive property of CaseFlo. No transfer of ownership occurs through platform usage.

4.2 License Limitations

Users are granted a limited, non-transferable, non-exclusive license to access the platform solely for its intended purposes. This license is revocable at CaseFlo's discretion and does not permit:

• Redistribution or commercial exploitation
• Modification or derivative works
• Removal of proprietary notices

5. Data Handling and Privacy

5.1 HIPAA Compliance

CaseFlo maintains HIPAA compliance for all aspects of data storage, transmission, and processing. All PHI is handled according to strict HIPAA Security and Privacy Rule standards. Users acknowledge their obligation to maintain HIPAA compliance in their use of the platform.

5.2 Data Control

CaseFlo retains absolute control over system data, including:

• Storage location and methodology
• Security implementations
• Access protocols
• Backup procedures

6. Payment Terms

6.1 Fee Structure

Users agree to pay all fees according to the pricing plan selected. Fees are non-refundable unless explicitly stated otherwise. CaseFlo reserves the right to modify pricing structures with 30 days notice.

6.2 Payment Processing

All payments are processed through secure third-party payment processors. CaseFlo does not store complete credit card information. Users are responsible for maintaining accurate billing information.

7. Limitations of Liability

7.1 Liability Restrictions

CaseFlo's total liability is explicitly limited to:

• The amount paid by the user for services in the preceding 12 months
• $500 USD, whichever is less

7.2 Damage Exclusions

CaseFlo explicitly disclaims all liability for:

• Indirect, consequential, exemplary, incidental, or punitive damages
• Lost profits or revenue

• Business interruption
• Any damages resulting from unauthorized access

8. Indemnification

Users agree to fully indemnify, defend, and hold harmless CaseFlo, its officers, directors, employees, agents, and affiliates from any and all claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising from:

• User's violation of these Terms
• User's use of the Service
• User's violation of any rights of another
• User's non-compliance with applicable laws

9. Termination

CaseFlo reserves the unconditional right to suspend or terminate service to any user at any time for any reason without prior notice. Upon termination:

• All licenses granted are immediately revoked
• Access to all platform features ceases
• Data may be retained according to regulatory requirements

10. Governing Law and Jurisdiction

• These terms are governed by the laws most favorable to CaseFlo
• Exclusive jurisdiction for any disputes is vested in CaseFlo's preferred legal venue
• Any legal action must be brought within one year of cause arising
